Welcome to SkillMart. By accessing or using the SkillMart platform, website, or mobile application, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services.

These terms govern your use of SkillMart across our website, web app, and mobile applications.

1. Acceptance of Terms

By registering, accessing, or using SkillMart, you confirm that you are at least 18 years old and legally capable of entering into binding agreements under Philippine laws.

Fifteen (15) years old and above can be employed, but refer to the Addendum/Legal Reference at the bottom of these terms and conditions. Individuals below fifteen (15) years old are strictly not allowed.

If you do not agree with these Terms and Conditions, you must not use the platform.

2. About SkillMart

SkillMart is an online platform that connects clients with skilled workers across the Philippines. Users may post jobs, communicate through the platform, and process secure payments for completed services.

SkillMart acts solely as a marketplace and is not a direct employer, contractor, or agency for any skilled worker listed on the platform.

3. User Accounts

Users must provide accurate and complete information during registration.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities conducted under your account
  • Updating your information when necessary

SkillMart reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Services and Job Posting

Clients may:

  • Post job requests
  • Review worker profiles
  • Communicate with workers through in-app messaging
  • Hire workers for agreed services

Skilled workers may:

  • Create professional profiles
  • Apply for posted jobs
  • Communicate with clients
  • Receive payments through the platform

Users agree not to post:

  • Illegal, fraudulent, or misleading jobs
  • Offensive or harmful content
  • Discriminatory requests
  • Services prohibited under Philippine law

5. Payments and Fees

Payments must be processed through SkillMart’s secure payment system.

Clients agree to:

  • Pay the agreed amount upon successful completion of work
  • Provide accurate billing information

Workers agree that:

  • Service fees or platform commissions may be deducted from payments
  • Payments are subject to verification and processing times

SkillMart reserves the right to modify service fees with prior notice.

6. User Conduct

Users must:

  • Treat others respectfully and professionally
  • Avoid harassment, abuse, or threatening behavior
  • Refrain from scams, fraud, or misleading activities
  • Comply with all applicable Philippine laws and regulations

Any violation may result in suspension or permanent removal from the platform.

7. Ratings and Reviews

Clients and workers may leave ratings and reviews based on actual experiences.

Reviews must:

  • Be honest and respectful
  • Not contain false, defamatory, or offensive statements

SkillMart may remove reviews that violate these guidelines.

8. Disputes Between Users

SkillMart may assist in resolving disputes, but does not guarantee outcomes.

Users are encouraged to:

  • Communicate professionally
  • Keep records of agreements and transactions
  • Report issues through official support channels

SkillMart is not liable for damages arising from disputes between users.

9. Cancellation and Refunds

Cancellation policies may vary depending on the agreement between the client and the worker.

Refund requests will be reviewed on a case-by-case basis. SkillMart reserves the right to determine eligibility for refunds based on available evidence.

10. Intellectual Property

All platform content, logos, branding, text, and software are owned by SkillMart and protected by intellectual property laws.

Users may not copy, distribute, or reproduce any content without written permission.

11. Privacy

SkillMart respects user privacy and handles personal information in accordance with applicable Philippine data privacy laws.

By using the platform, you consent to the collection and processing of your information for operational and security purposes.

12. Limitation of Liability

SkillMart is not responsible for:

  • Quality of services provided by workers
  • Conduct of clients or workers
  • Delays, damages, losses, or injuries arising from service transactions
  • Technical interruptions or platform downtime

Use of the platform is at your own risk.

13. Account Suspension and Termination

SkillMart may suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent activities
  • Harm the platform or its users
  • Breach applicable laws

14. Modifications to Terms

SkillMart reserves the right to update or modify these Terms and Conditions at any time.

Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

15. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

Addendum / Legal Reference

Fifteen (15) year-olds can legally work, but they are considered children under Labor Law (R.A. 7610/9231) and must not work in hazardous conditions.

Under Republic Act No. 9231, the minimum employable age is 15. No child below 15 years of age shall be employed, permitted, or suffered to work in any public or private undertaking.

Although persons 15 to 18 years of age are allowed to be employed, they shall NOT:

  • be engaged in the worst forms of child labor;
  • be employed as a model in advertisements promoting alcoholic beverages, intoxicating drinks, tobacco and its byproducts, gambling, or any form of violence or pornography;
  • work for more than 40 hours a week and not more than 8 hours a day;
  • work between 10:00 p.m. and 6:00 a.m. of the following day; and
  • be deprived of access to formal or non-formal education.
